The trial of James Gyakye Quayson, a member of the National Democratic Congress (NDC), will be heard on a daily basis starting from July 4, 2023, according to a ruling by Justice Mary Yanzuh of the Accra High Court.
The court ruled that its previous order on June 16, announcing the daily hearing arrangement, was lawful and that no grounds for a review had been presented.
Justice Yanzuh stated that adjournments are at the court’s discretion and not based on the convenience of the parties involved. She emphasized that the court’s order was in accordance with the law and did not violate Quayson’s rights by denying him time to campaign.
The defense lawyers had requested a review of the court’s order, arguing that Quayson needed time to campaign ahead of the Assin North by-election scheduled for June 27. They also presented documents showing statements made by the Attorney General, which they claimed prejudiced the case.
However, Justice Yanzuh ruled that the statements made by the Attorney General were not relevant to the issue at hand and did not warrant a review of the court’s decision.
She adjourned the proceedings to June 29 and July 4, taking into account the unavailability of the specific courtroom on Mondays, the upcoming by-election, and the holiday and Martyrs’ day. Afterward, the trial will proceed on a day-to-day basis.
Deputy Attorney General Diana Asonaba Dapaah expressed satisfaction with the court’s decision, stating that it aligns with established principles of law, emphasizing that the court has the authority to determine hearing dates.
Baba Jamal, a member of Quayson’s legal team, also expressed contentment with the ruling. He stated that although their application for additional time was dismissed, they are satisfied with the daily hearing arrangement after the by-election, as their main purpose was to secure time for campaigning.
